PSE is: Definition, Type, and Latest Obligations in Indonesia


In the world of digital industry, the term organizer of electronic systems or “PSE” is not a strange thing to be heard by the community. PSE is

PSE is an abbreviation of the organizer of the electronic system, namely referring to the understanding of every person, state organizer, business entity, and the community that provides, manages, and/or operates electronic systems individually or together to users of electronic systems for the needs of themselves and/or other parties.

Or in other words, PSE can also be interpreted as a legal subject that not only includes legal entities or government agencies, but also individuals or groups of people who carry out the activities of organizing electronic systems in various forms and interests.

Types of PSE

Based on Government Regulation Number 71 of 2019 concerning Implementation of Electronic Systems and Transactions (“PP No. 71 of 2019”), there are two types of PSE including:

  1. PSE Public Scope, namely the implementation of electronic systems carried out by state administrators or institutions appointed by state administrators.
  2. PSE Private Scope, namely the implementation of electronic systems by individuals, business entities, and the general public.

Who must list PSE?

The obligation to register as a PSE applies to every party who provides or organizes an electronic system in Indonesia, including:

  1. Government agencies that operate electronic systems.
  2. Business entities, the community, and individuals that provide, manage, and/or operate an electronic system for themselves or other parties. This includes portal organizers, sites, or applications used to offer or trade goods/services, financial services, distribution of paid digital materials, digital communication, search engines, electronic information providers, and processing personal data in electronic transactions.

How to register pse

The following are steps to register PSE:

  1. Submission of registration through OSS
    Submission is made through the Single Submission (OSS) online system. At this stage, PSE is required to fill out the registration form and attach the required documents in accordance with applicable norms, standards, procedures and criteria (NSPK).
  2. Data verification
    After the submission, the Ministry of Communication and Information will verify. If the data is declared complete and meets the requirements, PSE will get a PSE list.
  3. Print PSE List
    PSE can download and/or print a list that has been signed electronically. The trick is to log in back to the Oss.go.id page and access the link sent via confirmation email.
  4. Announcement
    After being registered, PSE data will be officially listed in the registered PSE list that can be accessed through the Pse.komdigi.go.id site.

What’s the risk if you don’t list PSE?

In the implementation of the electronic system, the party that does not register PSE can be subject to administrative sanctions because it is considered to have committed administrative violations. The administrative sanctions that can be imposed include the following:

  1. Written reprimand
  2. Administrative fine
  3. Temporary Termination of Services in the form of a part or all components or services in the relevant electronic system for a certain period of time
  4. Termination of access in the form of blocking access, account closure, and/or removal of content
  5. Expelled from the PSE list

After registering, it is important to ascertain whether the electronic system that you manage has been officially recorded or not. The following are steps that can be taken to check PSE status, including:

  1. Open the official website of the Ministry of Communication and Information at https://se.kominfo.go.id/home
  2. Select the “Find Pse” menu
  3. Use the search column to type the name of the website or application you want to check (if registered, the PSE status information will appear in the search results. Whereas if not found, it means that the PSE has not been registered with the Ministry of Communication and Information)
